1. Acceptance of Terms
By accessing or using Darkest Hour, you agree to these Terms. If you do not agree, do not use the service.
2. What Darkest Hour Provides
Darkest Hour provides a free dark-sky map, sky-condition and astronomy planning tools, editorial guides, optional affiliate/referral links, paid Pro subscriptions and optional secure guide downloads. The flagship paid product is the Pro night-sky planner for deciding when and where conditions are worth watching; free maps and guides remain acquisition and education surfaces.
3. Accounts and Access
Some features require a Supabase-powered account. Paid Pro access is attached to the signed-in email/account used for checkout. You are responsible for keeping your login secure and for using the same account when requesting support for paid access.
4. Subscriptions, Trials and Guide Purchases
- Pro subscriptions: billed monthly or yearly through Stripe unless cancelled.
- Trial access: trial or beta access may be offered separately from a paid subscription and is not proof of paid entitlement.
- Guide downloads: one-time guide purchases, when offered, are delivered through authenticated secure download routes.
- Cancellation: you may cancel recurring billing through the billing portal or by contacting support if the portal is unavailable.
- Refunds: payments are non-refundable except where required by law or where we choose to make a support exception.
- Price changes: we may change future pricing with reasonable notice where required.
5. Forecast, Map and Astronomy Data Limitations
Weather, cloud, moon, seeing, transparency, aurora, satellite, light-pollution, Bortle and SQM outputs are estimates or third-party/provider-derived signals. They may be delayed, incomplete, unavailable or wrong. Darkest Hour helps with planning; it does not guarantee actual sky conditions, safety, access, road conditions, land access, weather, visibility or event occurrence. Verify conditions independently before travel or equipment decisions.
6. Acceptable Use
You agree not to:
- Use the service unlawfully or in a way that harms others.
- Interfere with, scrape, overload or reverse engineer the service without permission.
- Bypass access controls for paid subscriptions, guide downloads or secure routes.
- Redistribute paid content, maps, code or generated outputs as a competing product.
- Use the service as the sole basis for safety-critical, emergency or professional decisions.
7. Intellectual Property and Data Sources
Darkest Hour owns its interface, code, copy, branding, generated planning briefs and original content unless otherwise stated. Some data is derived from or compared with public or third-party sources such as NASA/VIIRS, OpenStreetMap contributors, weather and astronomy providers. Third-party data and map sources remain subject to their own licences and terms.
8. Affiliate and Advertising Disclosure
Some links are affiliate, referral or advertising links. As an Amazon Associate, we may earn from qualifying purchases. We may also use Stay22 lodging links, Starlink referral links, Google AdSense ads and other partner links. These relationships may earn revenue at no additional cost to you. Editorial recommendations should remain contextual and should not be treated as independent professional advice.
9. Third-Party Services
The service integrates third parties including Cloudflare, Supabase, Stripe, Microsoft Clarity, Ahrefs Analytics, Google AdSense, Open-Meteo, OpenStreetMap/Nominatim, MapLibre-related services, Amazon Associates, Stay22 and Starlink. Your use of third-party services may be governed by their own terms and privacy policies.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARKEST HOUR DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY AND UNINTERRUPTED OPERATION.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARKEST HOUR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, WASTED TRAVEL, MISSED EVENTS, EQUIPMENT DAMAGE OR THIRD-PARTY SERVICE FAILURES ARISING FROM YOUR USE OF THE SERVICE.
12. Changes and Availability
We may modify, suspend or discontinue features, pricing, partner links, content, alerts or data integrations. We may update these Terms by posting a new version with a revised date.
13. Governing Law
These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles, except where consumer law requires otherwise.
